This website is operated by HiFlyer Drones. Throughout the website, the terms “we”, “us” and “our” refer to HiFlyer Drones.

HiFlyer Drones provides this website, including its information, products, tools and services, subject to your acceptance of these Terms of Service. By visiting our website, creating an account or purchasing from us, you agree to these Terms and any policies referenced in them.

Please read these Terms carefully before using our website. If you do not agree with them, you must not use the website or our services.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform through which we sell our products.

1. Eligibility and Online Store Terms

By using this website, you confirm that you are at least the age of majority in your state or territory of residence, or that you have permission from a parent or legal guardian.

You must not use our products, website or services for any unlawful or unauthorised purpose. You must not transmit viruses, malware or other harmful code.

A breach of these Terms may result in suspension or termination of your access to our website or services.

2. General Conditions

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

a product is unavailable;
pricing or product information contains an obvious error;
we reasonably suspect fraud, unauthorised payment, resale activity or misuse; or
fulfilling the order would breach a law or regulatory requirement.

If we cancel an order after payment has been received, we will refund the applicable amount to the original payment method.

You must not reproduce, duplicate, copy, sell, resell or exploit any part of our website or services without our prior written permission.

3. Website Information

We aim to keep the information on our website accurate, complete and current. However, general information is provided for reference and may change from time to time.

Product specifications, compatibility information, flight times, operating ranges, images and performance claims may vary depending on the model, configuration, environment, weather, battery condition, firmware and manner of use. You should review the product description and instructions before purchasing or operating a drone.

We may update or correct website content at any time. Nothing in this section limits any right you may have under the Australian Consumer Law.

4. Products, Availability and Pricing

All products are subject to availability. We may limit quantities, discontinue products or restrict sales where reasonably necessary.

Prices may change without notice. The price charged will be the price displayed at checkout when your order is submitted, except where there is an obvious pricing or technical error.

Unless stated otherwise, prices are displayed in Australian dollars and include GST where applicable. Shipping charges, if any, will be shown at checkout before you complete your purchase.

We make reasonable efforts to display product colours and images accurately, but appearance may vary depending on your screen and device settings.

5. Orders, Billing and Account Information

You agree to provide current, complete and accurate information when placing an order, including your name, email address, billing details and delivery address.

You are responsible for reviewing your order before submitting it. If you notice an error after placing an order, contact us as soon as possible at Sales@hiflyerdrones.com. We cannot guarantee that an order can be changed once it has entered processing or dispatch.

We may limit or cancel quantities purchased per person, household, account, payment method, billing address or delivery address where reasonably necessary. If we change or cancel an order, we will attempt to contact you using the details supplied at checkout.

6. Payment

Payment must be made using one of the methods offered at checkout. Your order is not confirmed until payment has been authorised and you receive an order confirmation.

Payments may be processed by third-party payment providers. Their own terms and privacy practices may apply to the processing of your payment.

7. Shipping and Delivery

Orders are dispatched from our Melbourne warehouse within 1–2 business days unless a product is listed as a pre-order.

Delivery generally takes 2–7 business days after dispatch, depending on your location. These timeframes are estimates and are not guaranteed. Delays may occur due to public holidays, severe weather, courier disruptions or other circumstances outside our reasonable control.

Orders are delivered through Australia Post. Tracking information will be sent to the email address provided at checkout once your order has been prepared for dispatch.

If an order has not arrived within 10 business days after dispatch, please contact Sales@hiflyerdrones.com so we can investigate.

8. Returns, Refunds and Consumer Guarantees

Our 30-day return policy applies to eligible change-of-mind returns. To qualify for a full change-of-mind refund, the product must be new, unused and unactivated. If a drone has been activated, we may decline a change-of-mind return or apply a reasonable restocking and handling fee based on its condition.

Our change-of-mind policy is separate from your legal rights. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a repair, replacement, refund or other remedy if a product fails to meet an applicable consumer guarantee.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition, warranty or remedy that cannot lawfully be excluded, restricted or modified.

To request a return or report a product issue, contact Sales@hiflyerdrones.com with your name, order number and a description of the issue.

9. Drone Operation and User Responsibilities

You are responsible for operating any drone safely, responsibly and in accordance with:

the manufacturer’s instructions and safety guidance;
all applicable aviation laws, regulations and airspace restrictions;
local privacy, surveillance and property laws; and
any registration, accreditation, licensing or approval requirements that apply to you or your intended use.

Before each flight, you should check the aircraft, propellers, batteries, controller, firmware, surroundings, weather and airspace conditions. You must not operate a drone while impaired or in a way that creates an unreasonable risk to people, property, aircraft or the environment.

You are responsible for determining whether a product is suitable and lawful for your intended location and purpose. Information on our website is general product information and is not legal, aviation or professional advice.

10. Product Warranties and Repairs

Any manufacturer’s warranty supplied with a product is provided in addition to, and does not replace, your rights under the Australian Consumer Law.

Warranty coverage may not apply to damage caused by crashes, misuse, water exposure, unauthorised modification, improper storage, failure to follow instructions or third-party repairs, unless the damage is attributable to a failure to meet a consumer guarantee or the warranty expressly provides otherwise.

Do not send a product to us before receiving return or service instructions. Unauthorised returns may delay assessment and processing.

11. Third-Party Products, Apps and Services

Some products may rely on third-party apps, software, firmware, maps, networks or services supplied by a manufacturer or another provider. Those third parties may have their own terms, privacy policies and system requirements.

We do not control third-party services and cannot guarantee that they will always be available, compatible or error-free. This does not limit any responsibility HiFlyer Drones has under the Australian Consumer Law in relation to products we sell.

Our website may contain links to third-party websites. We are not responsible for their content, security or privacy practices. You access third-party websites at your own discretion.

12. Optional Tools

We may provide access to optional third-party tools or integrations. Your use of those tools is voluntary and may be subject to additional third-party terms.

We may introduce new website features, tools or services in the future. These Terms will apply unless separate terms are provided.

13. Intellectual Property

The website and its content—including text, graphics, logos, product photographs, videos, design elements and software—are owned by or licensed to HiFlyer Drones and are protected by applicable intellectual property laws.

You may use the website for personal, non-commercial shopping and informational purposes. You must not copy, reproduce, modify, distribute, publish or commercially exploit our content without prior written permission.

Third-party product names, logos and trademarks belong to their respective owners.

14. Reviews, Feedback and Submissions

If you submit a review, photograph, comment, suggestion or other content to us, you confirm that:

you own the content or have permission to submit it;
it is accurate and does not mislead others;
it does not infringe another person’s rights; and
it is not unlawful, abusive, defamatory, obscene or harmful.

You grant HiFlyer Drones a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit and publish content you voluntarily submit for the purpose for which it was provided, including displaying product reviews or responding to feedback. This licence does not transfer ownership of your content to us.

We may remove submitted content that breaches these Terms or applicable law.

15. Prohibited Uses

You must not use the website or its content:

for an unlawful, fraudulent or misleading purpose;
to infringe intellectual property, privacy or other legal rights;
to harass, abuse, threaten or discriminate against another person;
to transmit malware or harmful code;
to collect or track another person’s information without authorisation;
to spam, phish, scrape or interfere with the website;
to bypass security measures; or
in any way that may damage or disrupt the website or services.

16. Personal Information

Our collection, use and handling of personal information through the website is governed by our Privacy Policy.

HiFlyer Drones does not operate the third-party apps used to control or support products sold through our store. Information collected through a manufacturer’s or third-party app is governed by that provider’s privacy policy, not ours.

17. Errors and Omissions

Occasionally, our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, delivery timeframes or availability.

We may correct an error, update information or cancel an affected order where reasonably necessary. If we cancel a paid order because of an error, we will issue a refund to the original payment method.

18. Disclaimer and Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot legally be excluded, restricted or modified.

To the maximum extent permitted by law, HiFlyer Drones is not responsible for indirect or consequential loss arising from your use of the website or products where that loss was not reasonably foreseeable or was caused by your unlawful, reckless or improper operation of a product.

We do not exclude liability for loss or damage caused by our negligence, breach of contract, breach of an applicable consumer guarantee or any other matter for which liability cannot lawfully be excluded.

19. Suspension and Termination

We may suspend or terminate access to the website or services if you materially breach these Terms, misuse our services or engage in unlawful or fraudulent activity.

Provisions that by their nature should continue after termination—including intellectual property, liability and governing-law provisions—will remain in effect.

20. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary. The remaining provisions will continue in effect.

21. Entire Agreement

These Terms, together with our Refund & Returns Policy, Shipping & Delivery Policy, Privacy Policy and any other policies referenced on the website, form the agreement between you and HiFlyer Drones concerning your use of the website and purchase of products.

22. Changes to These Terms

We may update these Terms by publishing a revised version on this page. Changes take effect from the date stated at the top of the revised Terms and will not retrospectively reduce rights relating to an order already placed.

Your continued use of the website after an update means the revised Terms apply to your future use of the website.

23. Governing Law

These Terms are governed by the laws of Victoria, Australia. You and HiFlyer Drones submit to the courts and tribunals of Victoria and any courts entitled to hear appeals from them.

Nothing in this section limits any rights you may have to bring a claim in another jurisdiction where applicable law permits.
